1. Acceptance of Terms

By registering, downloading, logging in, or providing services through the Serwex Partner application ("App") or partner portal, you ("Partner", "Service Provider", "Vendor", or "You") agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use or access the Serwex Partner application.

2. Partner Registration & Eligibility

  • Minimum Age & Legal Capacity: You must be at least 18 years old and legally competent to enter into a binding agreement under applicable laws in India.
  • Identity & KYC Verification: You agree to provide accurate, complete, and updated identity documentation, including government-issued ID proof (Aadhaar Card, PAN Card, Driving License, or Voter ID), address proof, and bank account details.
  • Background Checks: You authorize Serwex to perform background verifications, police verification, and work history validation prior to or after account activation.
  • Account Security: You are responsible for maintaining the confidentiality of your Serwex Partner login credentials. Any activity performed through your partner account will be deemed to be performed by you.

3. Service Obligations & Standards

As a registered partner on Serwex Partner, you agree to:

  • Professional Conduct: Deliver services with high quality, professionalism, punctuality, and skill.
  • Safety & Compliance: Adhere to all applicable safety guidelines, industry standards, health codes, and local regulations while executing customer orders.
  • Honesty & Integrity: Charge customers strictly according to the pricing guidelines and job estimates established through the Serwex platform.
  • Tooling & Equipment: Maintain your own functional tools, equipment, and transportation necessary to perform agreed service bookings.
  • Customer Respect: Maintain courteous and respectful behavior towards customers at all times. Harassment, verbal abuse, or inappropriate conduct will lead to immediate account termination.

4. Location Access & Job Allocation

  • Live Location Tracking: The Serwex Partner app relies on real-time location data (including foreground and background location) to match you with nearby service jobs and update customers on your arrival status.
  • Job Acceptances: You are free to accept or reject job requests based on your availability. However, frequent cancellations after job acceptance or unexcused no-shows may result in penalties or account suspension.

5. Payments, Fees & Payouts

  • Service Pricing & Platform Commission: Service rates and platform commission structures are defined in the Serwex Partner app. Serwex retains a designated platform service fee from completed bookings.
  • Payout Settlement: Net earnings after platform commission and applicable statutory tax deductions (such as TDS under Indian Income Tax regulations) will be credited to your verified bank account according to the payout schedule.
  • Prohibition of Off-Platform Cash / Transactions: You agree not to solicit, accept, or arrange direct off-platform payments or side contracts with customers introduced to you via Serwex Partner. Circumventing the platform is a breach of contract resulting in instant permanent deactivation.

6. Code of Conduct & Account Suspension

Serwex reserves the right to suspend or permanently terminate your Serwex Partner account immediately, without prior notice, under any of the following circumstances:

  • Provision of false, misleading, or forged identity documents.
  • Abusive, unprofessional, unsafe, or unlawful conduct towards customers, partners, or Serwex staff.
  • Consistently low performance ratings or high customer cancellation/complaint rates.
  • Soliciting off-platform work or demanding unauthorized extra fees from customers.
  • Violation of any intellectual property rights or confidentiality obligations.

7. Relationship of Parties

Your relationship with Serwex is that of an independent service contractor. Nothing in these Terms or in the Serwex Partner app shall be construed as creating an employer-employee relationship, joint venture, partnership, or agency between you and Serwex. You are solely responsible for your own taxes, insurance, and compliance obligations.

8. Limitation of Liability & Indemnification

  • Indemnification: You agree to indemnify and hold harmless Serwex, its affiliates, directors, and employees from any claims, damages, liabilities, losses, or expenses arising from your acts, omissions, negligence, property damage, or service performance.
  • Platform Availability: Serwex Partner is provided on an "as-is" and "as-available" basis. Serwex does not guarantee uninterrupted app availability or specific earnings levels.

9. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
